大眾捷運系統土地開發設定地上權案例介紹

摘要
依據大眾捷運法與大眾捷運系統土地開發辦法辦理之「台北都會區大眾捷運系統新莊線
松江南京站聯合開發區(捷)九用地土地開發」案(以下簡稱本案),係以設定地上權 50 年方式
交由民間投資人興建及營運之開發案。
本文的編排架構分為兩部分,第一部分介紹本案開發興建與營運相關議題,內容包含辦
理緣起、區位說明、招商條件、開發及營運計畫、建築設計與規劃、區域及都市環境塑造;
第二部分針對設定地上權在民間和公部門合作的建議和方向,內容包含招標標售方式設定及
建議、地上權移轉機制、租金和權利金規則制訂、融資辦理方式、與捷運設施銜接之課題、
建物保養與建物價值維護、及未來展望;最後說明結論。

Abstract
In accordance with the Mass Rapid Transit Act and Regulations for Mass Rapid Transit
System’s Land Development, the Taipei MRT Xinzhuang line’s Songjiang Nanjing Station Parcel
M9 joint development project was built and operated by the private sector based on a 50-year
superficies term.
This paper consists of two parts: Part one introduces issues related to construction and
operation, including implementation background, locations, investment conditions, development
and operation, architectural design and planning, regional and urban environment; part two
introduces suggestions for public-private cooperation in terms of superficies rights, including sale
modes, superficies transfer mechanisms, rents and royalties enactment, financing channels,
integrated MRT facilities, building renovation, value maintenance, and future prospects, together
with a conclusion.
