都會區規劃興建大眾捷運系統主要在於提供一「安全、舒適、便捷」的大眾運輸工具,
以「安全」而言,捷運系統所須考量之因素含括甚廣,除必要之設施產權維護與結構體耐震
堅固外,尚有電聯車及控制系統之安全與管理等,皆需面面俱到,確屬極其繁雜之整合工作,
其中有關捷運設施產權之安全維護方面,除於興建時加強設計施工品質外,完工後則有賴毗
鄰捷運路線之工程開發業者能相互配合與共同維護。本文將以日本、香港及新加坡等國家之
捷運禁限建規範及執行方式為背景,說明本局制定本國捷運禁限建之相關法令與規範;包括
「大眾捷運法」、「大眾捷運系統兩側公私有建築物與廣告物禁止及限制辦法」之修訂及其相
關子法等之制定過程、相互間之法緣關係及法令架構及條文內容等作禁一步說明。

Abstract
The main purpose of constructing a mass rapid transit system (MRTS) in a metropolitan area is
to offer a safe, rapid and comfortable public transportation network. As for Metro safety, in addition
to the essential safety of facilities and structures, a wide range of considerations such as the safety
and management of rolling stock, control systems and passengers all need to be integrated. To
ensure the safety of Metro facilities and structures, not only does the responsible authority have to
enhance design and building quality during construction, but protection and maintenance are also
required from those who develop projects along the rapid-transit routes after completion. This paper
aims to introduce the practices and models of the regulations governing construction in Japan, Hong
Kong and Singapore. The revision of the Mass Rapid Transit Act and the Regulations Governing
Construction of Public or Private Buildings and Advertising Structures along the Routes of the
Rapid Transit System, the institution of related sub-regulations, the origin of related regulations and
clauses are also included in this article.
